Terms and Conditions – FLOWBIO

These terms and conditions form the basis of the contract between you and FLOWBIO Ltd (company number 12590933) of Kala Studios, The Biscuit Factory, Drummond Road, London, SE16 4DG. They apply to the purchase of the FLOWBIO Sensor, your installation and use of the FLOWBIO App, and the combined use of both products. They also apply to the storage and handling of your data. By purchasing the Sensor or using the App or Service in any way, you agree to these Terms.

Important Notice

The FLOWBIO Sensor and App are not medical devices. They are intended for general wellness and fitness purposes only. They are not designed to diagnose, treat, cure, or prevent any disease or medical condition. They do not provide medical information and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before making any health, fitness, or nutrition decisions based on information from the FLOWBIO Sensor or App.

If you have any underlying health condition, including but not limited to high blood pressure, kidney disease, or a history of heart failure, consult your healthcare provider before using the FLOWBIO Sensor or App.

Assumption of Risk and Acknowledgment

By using the FLOWBIO Sensor and App, you acknowledge that you understand the nature and limitations of the product and voluntarily assume all risks associated with its use. These risks include but are not limited to risks related to health, physical activity, or interpretation of wellness data. You acknowledge that use of the FLOWBIO Sensor and App is entirely at your own risk and that data may not always be accurate.

Release and Limitation of Liability

You agree to accept full responsibility for any decisions or actions taken based on information provided by the FLOWBIO Sensor or App. You agree to release, indemnify, and hold harmless FLOWBIO, its officers, directors, employees, affiliates, and partners from any claims, liabilities, losses, damages, or expenses arising out of or related to your use or misuse of the Sensor or App, to the fullest extent permitted by law. Use of the Service is at your own risk.

Information About Us and the FLOWBIO Sensor

Details about FLOWBIO Ltd and the FLOWBIO Sensor are available on our website before you place your order. We take reasonable steps to ensure that information shown is accurate, including product images, although colours and designs may vary depending on your device version and settings. Once you submit an order, we will confirm receipt and send written confirmation to your registered email address.

Accepting Your Order

We accept orders made through our website only. An acknowledgement of your order is not acceptance. Your order is accepted only when we confirm that the Sensor has been dispatched.

How We Charge You

Payment is taken at checkout. Shipping charges are shown before payment. We will not dispatch your order without full payment. You are responsible for any customs duties, VAT, import fees, or other charges imposed by your country. If your card issuer refuses payment, your order will not be accepted.

Warranty

Your FLOWBIO Sensor comes with a 12-month warranty from the date of delivery. If your Sensor develops a fault due to a manufacturing defect during this period, we will repair or replace it free of charge.

This warranty covers technical malfunctions, manufacturing faults, and non-functional components not caused by user damage or everyday wear.

To make a warranty claim, email team@flowbio.com with your order confirmation and a description of the issue. We may ask for the return of the Sensor for inspection.

Refund Policy

Because the FLOWBIO Sensor is a personal, wearable device that comes into contact with bodily fluids, we are unable to offer refunds on any product that has been opened, activated, or used.

We offer a full refund on the product price (excluding shipping and handling costs) within 14 days of delivery, provided the item is unused, unopened, and in its original sealed condition.

If an order is returned to us due to customs rejection, unpaid duties, or refusal of import, we will issue a refund only if the product is unopened and unused. In these cases, the refund will be minus all shipping and handling costs, including the original outbound shipping fee and the return shipping fee charged by the carrier.

Once a Sensor has been opened, activated, or worn, it is no longer eligible for return or refund.

Using the FLOWBIO Sensor and App

The App is currently compatible with iPhone and Android. You may install the App on multiple iOS devices. To use the Sensor and App, you must:

Have an up-to-date iPhone with Bluetooth enabled.
Have an account with Garmin, Wahoo, Zwift, or Coros, and link these accounts to share workout data.

The Sensor is currently compatible with:

Indoor cycling
Outdoor cycling
Indoor running
Outdoor running

We will notify you when additional sports are supported.

We use reasonable endeavours to ensure the accuracy of data provided by the FLOWBIO Sensor and App. However, all exercise and wellness devices have inherent limitations and are not 100% accurate. Data accuracy may vary due to biological, environmental, and behavioural factors, as well as user input and usage conditions.

FLOWBIO Ltd makes no guarantees regarding the completeness, reliability, or accuracy of the data and is not responsible for inaccurate, incomplete, delayed, or inconsistent readings.

Service features, functionality, and data presentation may be modified, updated, or discontinued at any time without notice.

Inaccuracy of data, or disagreement with the information presented by the FLOWBIO Sensor or App, does not constitute a valid reason for return, refund, or replacement, to the fullest extent permitted by law.

Prohibited Use and Safety Requirements

You may not:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, design, or underlying structure of the FLOWBIO Sensor or App.
Create derivative works based on the hardware, software, firmware, or data generated by the Sensor or App.
Use the Sensor or App for medical, diagnostic, therapeutic, or clinical purposes, or for any purpose not expressly authorised in writing by FLOWBIO Ltd.
Use the Sensor while swimming, bathing, or showering, or submerge it in water or other liquids.
Use the Sensor in any manner that may cause damage, misuse, or abnormal wear, including the use of unapproved chargers.
Use the Sensor without the supplied USB-C silicone plug in place to protect against dust and moisture ingress.

Damage resulting from water ingress, improper charging, failure to use the supplied silicone plug, or other misuse is not covered under returns, refunds, or warranty, to the fullest extent permitted by law.

Environmental Limitations

The Sensor must not be operated or stored outside the temperature range of 0°C to 45°C. It must not be charged outside 0°C to 40°C. It is waterproof to IPX5, which does not cover swimming or submersion. It must not be left in direct sunlight or in windows exposed to sun.

Compensation and Losses

FLOWBIO Ltd is not responsible for losses that are:

Unexpected or unforeseeable.
Caused by events outside our control.
Avoidable by reasonable action on your part.

How We Use Your Data

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection and processing of your data. We apply appropriate technical and organisational measures to protect your data.

We may collect:

Identification data
Device data
Health and biometric data
Location data
App usage data

Data retention timelines:

Account data is retained until deletion.
Health and activity data is retained while you use the Sensor or App.

Complaints

Contact us at support@flowbio.com with feedback or complaints. We will respond and aim to resolve issues as quickly as possible.

General Contract Provisions

We may transfer our contract with you. We will notify you if this happens.
You may not transfer your rights without our written permission.
No other party has rights under this contract.
If a court finds part of this contract invalid, the remainder stays in effect.
If we delay enforcement of any term, we may still enforce it at a later time.
These Terms are governed by the laws of England and Wales.
